Terms and Conditions
TERMS AND CONDITIONS
APEX Exterior Cleaning — www.apexexteriorcleaningpw.com
APEX Exterior Cleaning is a DBA (doing business as) of Low Rain Enterprises LLC.
These Service Terms and Conditions apply when you request, schedule, or purchase exterior cleaning services from APEX Exterior Cleaning (“APEX,” “we,” “us,” or “our”). By approving a quote, scheduling service, allowing our crew to begin work, or otherwise accepting our services, you agree to these Terms.
1. Services Covered
APEX provides exterior cleaning and related property-maintenance services, which may include pressure washing/power washing, soft washing, window cleaning, roof cleaning, gutter cleaning, concrete cleaning, solar panel cleaning, deck cleaning, snow removal, and other services agreed upon with the customer. The exact service, areas, methods, and price are based on the quote or service agreement.
2. Quote and Scope of Work
A quote is based on the information available to APEX at the time it is prepared. The quote covers only the areas and services specifically identified. Additional work requested by the customer, or work required because actual site conditions differ materially from the information provided, may result in an additional charge that will be communicated before the additional work is performed when reasonably practicable.
3. How Customers Must Prepare
Before the crew arrives, customers must provide safe and reasonable access to the agreed work areas; remove or secure fragile, loose, valuable, or water-sensitive items near the work area; close windows and doors; secure pets and children away from active work zones; move vehicles or other items when requested; and identify irrigation, electrical equipment, delicate surfaces, known leaks, prior damage, or other conditions that could affect the work.
4. Customer’s Duty to Disclose Property Conditions
Customers must tell APEX about known property defects or conditions that could be affected by exterior cleaning, including loose siding, deteriorated paint, damaged seals, cracked windows, loose screens, damaged gutters, roof defects, failed caulking, unstable surfaces, exposed wiring, or previous damage. APEX is not responsible for damage caused by pre-existing conditions that were not reasonably visible or disclosed.
5. Cleaning Methods and Surface Suitability
APEX may select a pressure-washing, soft-washing, rinsing, water-filtration, or other appropriate cleaning method based on the material and condition. Not every stain or buildup can be completely removed. Certain surfaces may have permanent discoloration, oxidation, rust, oil, mineral deposits, organic staining, weathering, or deterioration that cleaning cannot fully correct. APEX may refuse or modify a requested method if it believes the method could unreasonably risk damage.
6. Water, Chemicals, and Surrounding Areas
Exterior cleaning can involve water, cleaning solutions, runoff, ladders, hoses, and equipment. Customers should identify sensitive plants, ponds, outdoor furniture, decorations, electrical equipment, or other areas requiring special attention. APEX will use reasonable care, but customers acknowledge that exterior cleaning may involve incidental water exposure and that pre-existing weaknesses may become apparent during service.
7. Weather and Unsafe Conditions
Service may be delayed, rescheduled, shortened, or stopped because of rain, wind, extreme temperatures, snow, ice, unsafe surfaces, electrical hazards, or other conditions that make work unsafe or likely to produce poor results. APEX will make reasonable efforts to communicate material scheduling changes.
8. Access and Customer/Occupant Safety
Customers must provide safe access to the property and keep children, pets, guests, and other unauthorized persons away from active work areas. APEX may decline to perform work where access is unsafe or where conditions create an unreasonable risk to people, property, equipment, or the environment.
9. Scheduling and Cancellations
Appointments are scheduled subject to availability and weather or site conditions. Customers should provide as much notice as possible for cancellations or rescheduling. Any cancellation or rescheduling fee will apply only if it was disclosed or agreed upon as part of the booking or quote.
10. Pricing and Payment
The customer agrees to pay the price confirmed for the agreed scope of work, plus any approved additional services or applicable charges. Payment is due according to the invoice or service agreement. If a payment method or payment deadline is specified in the quote or invoice, that requirement controls.
11. Inspection After Service
Customers should reasonably inspect the completed work and promptly notify APEX of any area they believe was missed or any service-related concern. APEX may request photographs or an on-site inspection. If an omission is verified, APEX may, at its discretion and consistent with the agreed scope, return to address the applicable area.
12. Existing Damage and Cleaning Limitations
Cleaning is not a repair service unless repair work is specifically agreed upon. APEX is not responsible for pre-existing cracks, leaks, failed seals, loose materials, defective installation, deteriorated surfaces, damaged fixtures, or other defects that existed before service. Cleaning may expose defects that were previously hidden by dirt, algae, moss, oxidation, or other buildup.
13. Roof, Window, Solar Panel, and Specialty Surfaces
Specialty surfaces can require different methods and may have manufacturer, age, condition, or installation limitations. APEX may decline work on a surface that is unsafe, excessively deteriorated, inaccessible, or unsuitable for the requested cleaning process. Customers should disclose known warranties or manufacturer restrictions before service.
14. Property Damage Claims
If a customer believes APEX caused damage during service, the customer should notify APEX promptly and provide reasonable access for inspection. APEX will investigate the claim and determine an appropriate response based on the condition of the property before service, the agreed scope, the cleaning method used, and the available evidence. Nothing in these Terms excludes liability that cannot legally be excluded.
15. Customer Cooperation
Customers agree to cooperate with reasonable requests from APEX that are necessary to safely and properly perform the agreed services, including providing access, moving items, securing pets, confirming service areas, and communicating known hazards.
16. Service Refusal or Termination
APEX may refuse, postpone, or stop service if the property is unsafe, access is unavailable, the customer requests a method that APEX reasonably believes is unsafe or inappropriate, the customer materially misrepresents site conditions, or continuing work would create an unreasonable risk.
17. Changes to These Terms
APEX may update these Service Terms from time to time. The Terms applicable to a particular job are the Terms in effect when the service is approved or scheduled, unless a written service agreement states otherwise.
18. Governing Law
These Terms are governed by applicable laws of the State of Washington. Any dispute will be handled in a court or other forum having appropriate jurisdiction, subject to applicable law.
